In 2007, the Georgia Legislature adopted the Georgia Advance Directive for Health Care Act, which effectively replaced the living will and durable power of attorney for health care into a single document called the Advance Directive for Health Care.
Typically, an individual will appoint a primary agent along with two backup agents to make medical decisions on their behalf when he or she lacks sufficient capacity to do so himself or herself. Both the Advance Directive for Health Care and the Durable Financial Power of Attorney are essential for any effective estate plan.
